We can provide the legal advice and representation to ensure that when you are faced with difficulties in getting your child or young person the right support for their Special Educational Needs (SEN), it can be overwhelming.

As carers, parents or guardians, you can use important legal rights to obtain the right educational provision for your child, if they have SEN or you believe they may have. Our team are here to help you navigate the law to achieve the best outcome for your child or young person.

Education, Health and Care Plan’s (EHCP)

Children and young people up to the age of 25 years old may be eligible for an Education, Health and Care Plan (EHCP). An EHCP is a legal document that sets out what special educational needs the child or young person has, what support is needed to meet these needs and what setting (or type of setting) they are to attend for education. Importantly, an EHCP is legally enforceable to ensure the person is provided with the educational support set out within the EHCP funded by the Local Authority.

What we can help you with

Our Special Educational Needs legal specialists can assist with many aspects of obtaining the right educational support.

We can provide expert guidance on the following issues:

  • Requesting an EHCP Needs Assessment (the first stage of obtaining an EHCP)
  • Appealing a decision from a Local Authority to refuse to assess for an EHCP
  • Appealing a decision from a Local Authority refusing to issue an EHCP following an assessment
  • Appeal against the content of an EHCP (sections B, F and I)
  • EHCP Professional Review – to check and advise on improvements to be made to an existing EHCP

At Culver Law we are dedicated to protecting the most vulnerable in society, and we firmly believe that children and young people with SEN can best achieve their full potential with the right educational and legal support.

We also support families with deaf parents or carers or where children or young people are deaf or hard of hearing. Understanding deeply the barriers faced by the deaf community means we can tailor the guidance to the unique requirements of the deaf child or young person. In addition, we will ensure that appropriate communication support is in place so that all members of the family can fully engage with schools and local authorities to access the SEN process.
