What is mediation?

Mediation is a voluntary, structured and confidential process that helps parties resolve disputes without the need for court proceedings, in which an independent mediator helps parties explore solutions and reach agreement.

It allows those involved to retain control over the outcome, rather than having a decision imposed by a court.

Mediation can take place before proceedings are issued, or alongside ongoing litigation, and often results in quicker and more cost-effective resolution than court action.

When is mediation appropriate?

Mediation is particularly effective where there is a desire to resolve matters constructively and avoid the stress, delay and expense of more formulaic legal action. It is increasingly the go-to process for resolving disputes involving:

  • Wills, estates and inheritance

  • Trusts and funds

  • Family and relationship breakdowns

  • Beneficiary or executor disagreements

  • Court of Protection and deputyship issues

  • Other private client and civil matters such as Lasting Power of Attorney

How much does mediation cost?

Costs will vary depending on several factors including the number of parties, amount in dispute and number of hours per day. The guideline fees per day which generally apply are as follows:
  • Claims up to £100K in value: £960 + VAT per party, per day

  • Claims between £100K-£1million in value: £1200 + VAT per party, per day

  • Claims between £1million-£2million in value: £1440 + VAT per party, per day

  • Claims over £2million in value: £1660 + VAT per party, per day

What’s included in the fee?
  • A full day comprising up to 8 hours of mediation (usually 10.00am – 6.00pm).
  • Full mediation preparation, pre-mediation meeting, site visits, travel time, and follow up for 7 days after the mediation.
  • Two parties in the mediation, with the costs usually shared equally. Additional parties will add £450 + VAT per party, per day to the overall daily fee.
What’s excluded from the fee?
  • A half day’s mediation for smaller value cases, for which the fee is £650 + VAT per party, per half day (a half day is classed as 4 hours of mediation).
  • Overtime, which is charged at £100 + VAT per party, per hour.
  • Expenses including travel, accommodation and other necessary expenses which will be charged at net cost.
What else do you need to know about fees?
  • All fees are payable at least 3 working days before the mediation start date, as mediation costs are due in cleared funds before the mediation.
  • Charges for expenses and overtime are to be paid within 5 working days of invoice. In some cases, on account payments will be requested.
  • Cancellation 10 working days or more before the mediation start date will mean no fee is due to be paid.
  • Cancellation 3-10 working days before the mediation start date will mean half of the full fee is due to be paid.
  • Cancellation 1-2 working days before the mediation start date will mean the full fee is due to be paid.
  • Postponement with 5 or fewer working days’ notice, as long as the mediation is scheduled promptly for another date, will mean 40% of the initial fee is due to be paid, plus the full fee for the rescheduled date.
